As part of the 2021 Infrastructure and Jobs Act, the United States Congress created a reporting regime for brokers of digital assets. The Treasury Department’s definition of a broker is expansive, but with numerous exceptions and exemptions built-in. The Treasury Department has also released several revenue rulings providing transitional filing and withholding relief for various types of transactions and brokers. This presentation will cover topics such as basis reporting, specific identification, backup withholding, dual classification assets, real estate purchased for digital assets, and special rules for multiple brokers, NFTs, and stablecoins.
